El nuevo modelo de Estado constitucional

Sin intención de defraudar expectativas, la entrega de esta sección
analiza varios aspectos de lo que se ha llamado nuevo modelo de Estado
constitucional, separando los modelos “legislativo” y “constitucional”
del estado de derecho, bajo las premisas de que las constituciones son
reflejo de la moral social y “ningún modelo de Estado es perfecto”.

Éste es un aspecto que está muy presente en Rousseau, quien entiende que la generalidad y la abstracción son características de la ley, lo que, unido a la generalidad de la voluntad legisladora, le conduce a proclamar que la ley no puede ser injusta, “puesto que nadie es injusto consigo mismo”.
