Family and religious freedom in Uruguay

Abstract

The research explores and posits the thesis that the family is subject to rights and freedoms under Uruguayan law, which provides this family institution with autonomous protection as the holder of the right to religious freedom, in addition to recognizing and protecting the freedom of conscience and religion of its members. Based on the international human rights law signed by the country, the main constitutional provisions in this regard and the not always consistent regulation by legislation are highlighted. A survey of recent cases resolved by case law is carried out, which has contributed to an updated protection of this fundamental freedom.

Carmen Asiaín Pereira, University of Montevideo

Doctor of Law and Social Sciences from the University of the Republic, Uruguay. She pursued doctoral studies at the Complutense University of Madrid, dissertation pending. Professor of Constitutional Law, Faculty of Law, University of Montevideo. She also teaches Human Rights and Business at the same university and Law and Religion at the Monsignor M. Soler University Institute. Former President of the Latin American Consortium for Religious Freedom. Member of the Executive Council of ICLARS (International Center for Law and Religion Studies). Senator of the Republic 2015-2030, currently an alternate.
