The relationship between family and religious freedom in Peru. Outlines and challenges

Abstract

This paper seeks to explore the relationship that exists today in Peru between “family” and “religious freedom,” the influence of religion on marriage law, forms of marriage celebration, the penalties that ministers of religion must comply with for not observing the civil formalities of marriage, and the concerns that religious groups have in this regard in light of the 2010 Religious Freedom Law in Peru. We will analyze the debate on the right of parents to make specific decisions about their children’s education, based primarily on their own moral and religious convictions, in accordance with Law No. 31498, enacted in Peru on June 23, 2022.

Lawyer from the Pontifical Catholic University of Peru, with a degree in Matrimonial Annulments from the Complutense University of Madrid, founding member of the Institute of Ecclesiastical Law of Peru (1994), Founding Member of the Latin American Consortium for Religious Freedom – CLLR (2000), former director of the Legal Advisory Office of the Peruvian Episcopal Conference (1994-2003 and 2021-2023), director of the Institute for the Development and Protection of Religious Freedom in Peru.

Priest of the Diocese of Callao (Peru), with 30 years of priestly life, Licentiate in Sacred Theology, Doctor of Canon Law from the San Dámaso Ecclesiastical University (Madrid, Spain). Professor of Canon Law and Ecclesiastical Law of the State at the Redemptoris Mater Faculty of Theology (Callao) and member of the Judicial Tribunal of the Diocese of Callao.
