Challenges to religious principles and the legal framework of the family in Paraguay. Implications for education and autonomy

Abstract

In Paraguay, a historically religious nation with a recent decline in Catholicism, the tension generated by children questioning their parents’ religious principles is analyzed, affecting faith, family, and responsibility. The Constitution protects the family (Articles 49 and 50), and parental authority (Article 70 of the Code on Children and Adolescents) establishes the parental duty to promote moral values and norms. However, the law guarantees religious and ideological freedom (Art. 24 of the Constitution), allowing minors to develop their religious self-determination as their intellectual, volitional, and emotional structures mature. This complex dynamic is linked to opposition to the Educational Transformation Law, motivated by social concern about the possible introduction of gender approaches and the impact on national sovereignty.

Author Biography

Walter Alexis Collar, Catholic University of Our Lady of the Assumption – Alto Paraná

Father Walter Alexis Collar was born in Presidente Franco City on February 13, 1987. He completed his philosophical studies at the San José Major Seminary from 2006 to 2008, and his theological studies from 2008 to 2011 at the Pontifical University of the Holy Cross in Rome. He earned a licentiate degree in Sacred Theology with a specialization in Biblical Theology from the Pontifical Gregorian University in Rome between 2017 and 2020. He is currently pursuing a master's degree in Scientific Research at the National University of Education (UNE). Since 2020, he has been a professor at the Catholic University of Asunción - Alto Paraná Campus (UCAP), where he collaborates in institutional management and in programs related to research and education. His profile combines a pastoral vocation with a solid academic foundation in the social sciences and humanities, geared towards research and community service.
