Religion and marriage law. Contours and challenges in Europe

Abstract

This paper points out some of the conflicts and challenges that religion and marriage law pose at the European level. In particular, the extent to which the national legislator’s margin of discretion should be allowed to respond to the pluralism of contemporary societies, which is naturally also reflected in the field of family relations? The European legal coordinates and the main interpretative lines of the European Court of Human Rights are analysed with the aim of outlining where the European institutions are heading in the protection of the right to marry and to found a family, especially when interpreted in connection with the exercise of other fundamental rights.

Silvia Meseguer Velasco, Faculty of Law of the Complutense University of Madrid

Full Professor (accredited chair) at the Faculty of Law of the Complutense University of Madrid. Corresponding member of the Royal Academy of Jurisprudence and Legislation of Spain. She has published numerous book chapters and articles in various national and international legal journals, and is the author of several monographs, the most recent being: State Cooperation with Religion in Europe, Aranzadi, 2024.
