This scientific research is characterized by being considered a legal review about the consideration of gastronomic roots as an essential part of law, specifically, of Transgenerational Law.
Based on the legal-legal and analytical-synthetic content analysis method, a deductive-inductive review of international, regional and internal law instruments that are linked to the traditional gastronomic theme is developed. In this sense, the General Objective of the research is established: "To expose and demonstrate, based on a legal-legal analytical-synthetic development, that gastronomic roots are transgenerational rights adhering to the theory of Human Rights."
Finally, it is proven that gastronomic roots are transgenerational rights and that they imply a high commitment on the part of Sovereign States to guarantee and safeguard them, with the firm purpose of elevating the Mexican gastronomic heritage to legal and juridical status, considering the mechanisms of Human Rights as an optimal means.
